Welcome to TECHPLANT LLC. By accessing this website and purchasing products from this website, you agree to the following terms and conditions.
If you do not agree to these terms, you should not purchase or use products sold by TECHPLANT LLC.
Product Use
TECHPLANT LLC products are designed for horticultural and decorative plant support purposes only.
TECHPLANT planks are intended to be placed inside plant pots or containers to support climbing plants.
Products must be used responsibly. Improper use, modification, or use outside the intended purpose may result in product instability, tipping plants, falling containers, property damage, or personal injury.
TECHPLANT LLC does not control the conditions in which the product is used, including but not limited to the type of pot, soil composition, plant species, watering practices, environmental conditions, or plant growth over time.
The customer assumes full responsibility for determining whether their pot, container, plant, and growing medium provide sufficient stability to safely support the plank and plant.
Container Stability Responsibility
The purchaser is solely responsible for ensuring that the plank is placed in a stable and appropriate plant container.
Stability of the plank depends on factors including but not limited to:

pot size and shape
-
pot weight and base stability
-
soil composition and density
-
plant size and growth
-
root development
-
watering practices and water saturation
-
placement of the container
Plants may increase in weight over time as they grow and retain water. These changes may affect the stability of the container and plank.
TECHPLANT LLC cannot guarantee stability of any pot, plant, or container system and is not responsible for tipping plants, falling containers, or resulting property damage or injury.
Stacking of Planks
TECHPLANT planks may be stacked vertically within a plant container to create extended support for climbing plants.
Stacking increases the total height, weight, and leverage within the pot and may affect stability.
For typical plant support use, TECHPLANT LLC generally recommends no more than approximately 6–8 planks stacked vertically, provided that the plant container is sufficiently large, heavy, and stable to support the plant and plank system.
The appropriate number of planks depends on factors including:

pot size and weight
-
soil depth and density
-
plant species and growth
-
plant weight and moisture retention
-
placement of the container
Customers are responsible for determining whether their container system can safely support stacked planks.
TECHPLANT LLC does not guarantee stability of stacked plank configurations and assumes no responsibility for tipping plants, falling containers, or damages resulting from stacked installations.
Natural Wood Product Disclaimer
TECHPLANT products are made from natural wood materials.
Natural wood characteristics may include but are not limited to:

knots
-
grain variation
-
small cracks or checking
-
surface roughness
-
dimensional movement due to humidity
-
natural irregularities
Wood may expand, contract, warp, split, or change appearance over time depending on environmental conditions including humidity, watering practices, and plant growth.
These characteristics are inherent to natural wood products and do not constitute defects.
Splinter and Handling Warning
Because TECHPLANT products are made from natural wood, splinters, sharp wood fibers, or rough surfaces may occur during handling or use.
Customers should exercise appropriate care when handling wooden products and may choose to use protective gloves when installing or adjusting the product.
TECHPLANT LLC is not liable for injury resulting from the handling or use of natural wood products, including but not limited to splinters or contact with wood surfaces.
Product Condition
All products are sold “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.
TECHPLANT LLC disclaims all warranties including but not limited to:

implied warranties of merchantability
-
fitness for a particular purpose
-
durability under specific environmental conditions
-
suitability for specific plant species or growing environments
Limitation of Liability
To the maximum extent permitted by law, TECHPLANT LLC shall not be liable for any damages arising from the purchase, handling, modification, or use of its products.
This includes but is not limited to:

property damage
-
tipping plants or containers
-
falling objects
-
personal injury
-
plant loss
-
indirect damages
-
incidental damages
-
consequential damages
Customers assume all risks associated with the use of the product within their plant container system.
TECHPLANT LLC's total liability, if any, shall not exceed the purchase price paid for the product.
Maintenance Responsibility
Customers are responsible for regularly inspecting their plant container system for safety and stability.
This includes inspection of:

pot stability
-
soil integrity
-
plank condition
-
plant growth and increased weight
-
water saturation
-
environmental effects
If instability or damage is observed, the product should be removed or the container system adjusted to restore stability.
Product Modification
Any modification, alteration, drilling, cutting, refinishing, or structural change to the product is performed at the purchaser’s own risk.
TECHPLANT LLC is not responsible for damages or injury resulting from modified products.
Returns and Refunds
Returns are accepted in accordance with our Return Policy.
Products that have been used, modified, installed, or damaged may not be eligible for return.
Indemnification
By purchasing and using products from this website, the customer agrees to indemnify, defend, and hold harmless TECHPLANT LLC, its owners, employees, and affiliates from any claims, damages, liabilities, costs, or legal expenses arising from:

misuse of the product
-
improper use within a plant container system
-
unstable or inadequate plant pots
-
plant weight or growth changes
-
stacked plank configurations
-
product modification
-
failure to follow safety guidance
-
environmental conditions affecting the product
Governing Law
These Terms of Service shall be governed and interpreted in accordance with the laws of the State of Wisconsin, United States, without regard to conflict of law principles.
